Bundestag to debate competing organ donation proposals
The German Bundestag is set to debate competing proposals regarding organ donation laws. One initiative, supported by over 200 lawmakers, seeks to introduce an opt-out system (Widerspruchsregelung). Under this model, adults would be considered automatic donors unless they have explicitly registered a refusal.
Conversely, a group of 58 lawmakers from the Union, SPD, Greens, and Left parties has submitted a motion opposing this change. They argue that an opt-out system constitutes a “serious and legally controversial interference with the right to self-determination.” This group advocates for increased public education and improved documentation processes, such as prompting citizens to declare their wishes shortly after turning 18.
Supporters of the opt-out model point to the critical shortage of donor organs, while opponents warn that assuming consent from silence could undermine trust in the healthcare system. Additionally, regional political bodies, such as the Rhineland-Palatinate state parliament, have expressed support for moving toward an opt-out solution to address the shortage.
