Busan court sentences student for using AI to cheat on English exams

A student preparing for the tax accountant exam has been sentenced to six months in prison, suspended for one year, for using artificial intelligence to cheat on official English exams. The Busan District Court Western Branch also ordered 80 hours of community service for the defendant.

According to court findings, the individual stole preliminary English exam papers from a middle school in Sasang-gu, Busan, on two separate occasions in March and April. The defendant photographed the stolen papers and used Google’s AI service, Gemini, to identify the correct answers. The answers were then written on the defendant's right palm to be used during the actual exams.

The motive was to secure a score of at least 65, a requirement for the tax accountant examination. The court noted that the crime was repeated and the method was bold, stating that such actions damage the fairness and trust essential to competitive examinations. Although the defendant attempted to provide 100,000 KRW to each victim as a deposit, the victims refused the funds, and the gesture was not considered a mitigating factor in the sentencing.
