Bytom authorities fine driver for illegal waste dumping
In Bytom, the Municipal Guard successfully identified an individual responsible for illegally dumping construction waste using mobile phototraps. The device captured a truck with its cargo bed raised, confirming the illegal discharge. The perpetrator admitted to the offense and was fined 4,000 PLN, with an additional requirement to clear the site and transport the waste to a Selective Municipal Waste Collection Point (PSZOK).
Legal regulations in Poland place a heavy burden on property owners regarding illegal dumping. Under the Waste Act, there is a legal presumption that the person in control of the land is the possessor of any waste found there. This means owners are responsible for removal costs unless they can identify and prove the identity of the actual perpetrator. Furthermore, if unsegregated waste is placed in communal bins, the entire property may face increased waste management fees, potentially up to four times the standard rate.
