Cade advances analysis of EMS acquisition of Medley
Brazil's antitrust regulator, Cade, has advanced its analysis regarding EMS's acquisition of Medley. The General Superintendence has classified the transaction as complex and requested additional information to address potential market concentration.
Concerns are specifically focused on niche pharmaceutical markets, including drugs used for fertility (ovulation induction) and certain migraine treatments. In the fertility category, the combined market share of manufacturers could reach between 90% and 100% by 2025. In the migraine segment involving naratriptan, the aggregate share could reach 50% to 60%. While Cade sees less risk in the remaining 253 medications involved in the deal, the request for further diligence makes an approval within the current month less certain.
