California doctors and insurers sue over healthcare tax
The California Medical Association and the California Association of Health Plans have filed a lawsuit with the California Supreme Court against Governor Gavin Newsom and the state Legislature. The plaintiffs allege that a newly approved healthcare tax, known as the managed care organization (MCO) tax, violates Proposition 35, a 2024 voter initiative that limits healthcare taxes and mandates specific revenue uses.
Insurance firms estimate the tax will increase monthly premiums by approximately $8.85 per enrollee. This translates to an estimated annual increase of $100 for individuals and $400 for a family of four. Insurers have indicated they intend to pass these costs directly to consumers.
State officials defend the tax as a necessary measure to address revenue shortfalls caused by federal funding cuts to Medi-Cal. A spokesperson for Governor Newsom stated that the state disagrees with the legal claims and expects the courts to uphold the tax, which is intended to fund healthcare services.
