California Governor Newsom signs laws targeting immigration detention

Governor Gavin Newsom has signed a package of approximately 20 bills aimed at increasing oversight of federal immigration enforcement and expanding protections for immigrants in California. A central component of this legislation is Assembly Bill 1633, which imposes a 25% tax on the California-source gross income of private detention facility operators.

The measures include a ban on the use of electric shock gloves by law enforcement, increased health and safety oversight at detention centers, and expanded public access to detention records. Additionally, a new state law will allow individuals to sue federal officials for alleged violations of their constitutional rights.

The Private Detention Facility Tax Law is set to take effect on July 1, 2028. While supporters argue the bills will provide essential resources and legal representation for detainees, critics note the tax implementation occurs after Newsom’s term ends and question the ultimate allocation of the revenue.
