California insurance claims and comparative fault systems

Insurance claims can become increasingly complex when liability, injury, or payment responsibility is disputed. Factors such as delayed injury symptoms, multiple drivers sharing fault, or the presence of preexisting medical conditions can complicate the valuation of a loss.

In California, a comparative-fault system is utilized. Under this system, if an injured person is found partially responsible for the harm, their total damages are typically reduced by the percentage of responsibility assigned to them. For instance, a claimant found 20% responsible would generally see their awarded damages reduced by 20%.

While police reports offer useful information, they do not definitively decide civil claims. Evidence from witnesses, traffic cameras, vehicle data, and photographs is often necessary to establish the full context of an accident, as drivers may admit to contact while still disputing specific details like speed or lane position.
