California law mandates disclosure of PFAS pesticide use

California has enacted a new law, AB 1603, requiring the state to track and publicly disclose the use of pesticides containing per- and polyfluoroalkyl substances (PFAS), often referred to as ‘forever chemicals.’ Signed by Governor Gavin Newsom, the legislation mandates that the California Department of Pesticide Regulation (DPR) monitor the use of these substances and maintain a publicly accessible database.

The DPR is required to publish a comprehensive list of registered pesticides containing PFAS on its website and distribute this information to county agricultural commissioners by January 1, 2028. The law follows findings from the Environmental Working Group (EWG), which reported that 37% of non-organic California produce samples contained PFAS residues, including over 90% of tested non-organic peaches, nectarines, and plums.
