California legal guidelines for car accident and injury claims

In California, individuals involved in motor vehicle accidents have several legal avenues for pursuing compensation for injuries and property damage. Under state law, passengers injured in a crash can sue the driver of their vehicle, the other driver involved, or both, provided negligence is established. Because passengers typically do not control the vehicle, they are often in a strong position to recover compensation through the at-fault parties' insurance policies.

For incidents involving road rage, victims can file civil lawsuits for medical expenses, lost wages, and pain and suffering. While road rage behavior may trigger criminal charges such as assault with a deadly weapon, a criminal conviction is not required to pursue a civil claim.

Additionally, claimants may choose to manage their own vehicle property damage claims while hiring an attorney specifically to handle bodily injury claims. However, it is critical to clarify the scope of legal representation in writing, as property damage and personal injury claims are governed by different legal rules, procedures, and filing deadlines.
