California Legislature passes Gabriel’s Law to strengthen child welfare protections

The California Legislature has passed Assembly Bill 2304, known as ‘Gabriel’s Law,’ which is now headed to Governor Gavin Newsom for his signature. The legislation aims to strengthen protections for abused children following the 2013 death of 8-year-old Gabriel Fernandez, a case that highlighted significant failures within the child welfare system.

Under the new law, social workers will be required to ensure that a child receives appropriate medical care if they appear to need immediate emergency, surgical, or other remedial treatment. Additionally, the bill clarifies that social workers who knowingly falsify or manipulate official records can be held accountable under existing laws.

Assemblyman Tom Lackey, who has championed various versions of this reform since 2018, stated that the law is a step toward fulfilling the responsibility to protect vulnerable children. The case of Gabriel Fernandez gained renewed national prominence in 2020 through the Netflix documentary series ‘The Trials of Gabriel Fernandez.’
