California Proposition 40 billionaire wealth tax faces intense opposition

California voters will decide on Proposition 40 in November, a ballot measure that would impose a one-time 5% tax on the net worth of approximately 200 billionaires residing in the state on January 1, 2026. The initiative, sponsored by the SEIU-United Healthcare Workers West, aims to generate tens of billions of dollars to fund healthcare programs, education, and food assistance, primarily to offset anticipated federal funding cuts.

Opposition to the measure has reached significant levels, with campaign spending exceeding $1 million per day in September. Tech billionaires, including Sergey Brin, Peter Thiel, and Eric Schmidt, are among the primary donors to the anti-tax campaign, which has raised over $340 million. Opponents argue the tax could act as a 'Trojan horse' for broader taxation and warn that it may drive wealthy residents out of the state, potentially causing an annual loss of up to $1 billion in state income tax.

The California Legislative Analyst’s Office notes that while the tax could raise substantial revenue, the exact amount remains uncertain due to fluctuations in stock prices and potential changes in taxpayer behavior. Additionally, the measure contains language that could allow the Legislature to amend the tax with a two-thirds vote, provided amendments align with the original purpose of the act.
