Canada clarifies work permit requirements for foreign nationals

Immigration, Refugees and Citizenship Canada (IRCC) has issued guidance clarifying that an electronic travel authorisation (eTA) or a visitor visa does not grant foreign nationals the right to work in the country. While these documents allow for entry as visitors, individuals intending to seek employment must obtain a valid work permit and meet specific eligibility requirements.

There are different types of permits available, including employer-specific work permits, which require a job offer and restrict the holder to certain conditions, and open work permits, which allow for more flexibility. For those whose current permits are nearing expiration, a Labour Market Impact Assessment (LMIA) may serve as a pathway to continue working. An LMIA is used by employers to demonstrate a need for a temporary foreign worker and that hiring them will not negatively impact the Canadian labour market.

Prospective applicants are advised to determine their specific permit requirements and apply through appropriate channels, whether from inside or outside Canada, before beginning any employment.
