Canadian youth launch historic climate lawsuit against federal government
A landmark legal battle, La Rose v. His Majesty the King, has commenced in a Vancouver federal court. Fifteen young Canadians, aged 17 to 24, are suing the Canadian government, alleging that its climate policies violate their constitutional rights to life, liberty, and security as guaranteed by the Canadian Charter of Rights and Freedoms.
The plaintiffs challenge the 2021 Net-Zero Emissions Accountability Act and the government’s 2030 climate plan. They argue these policies fail to provide a trajectory compatible with a safe climate. While the government maintains that climate change is a political issue, the plaintiffs' legal team asserts it is a judicial matter because government inaction causes direct harm to citizens.
The trial is expected to last five weeks, with hearings scheduled to continue through February 2027. Legal teams plan to call upon scientists, engineers, and medical professionals to testify regarding the physical and mental health impacts of extreme heat, flooding, and wildfire smoke on young people. The plaintiffs are seeking a court order to compel the government to implement a science-based, rapid decarbonization plan.
