Canary Islands court grants disability benefits for cosmetic surgery complications
The High Court of Justice of the Canary Islands (TSJC) has ruled that a worker is entitled to temporary disability benefits following complications from elective cosmetic surgery.
The worker underwent several procedures, including an abdominoplasty and liposuction, in March 2024. Following the surgery, she suffered from wound dehiscence and an abdominal seroma, requiring medical assistance and daily care for several weeks.
While the court noted that voluntary cosmetic surgery itself is not a protected contingency under the Social Security system, it ruled that the specific medical complications arising from the procedure do qualify for benefits. Consequently, the court ordered Mutua Fraternidad Muprespa to pay the corresponding benefits for the period between March 10 and May 6, 2024.
