Canary Islands Supreme Court Issues Rulings on Immigration Claim and Workplace Discrimination

The Tribunal Superior de Justicia de Canarias (TSJC) clarified that a young woman intercepted off El Hierro was over 18, rejecting reports that she had been ordered expelled and placed in a detention centre. Medical examinations confirmed her age, and the court affirmed that the proper deportation procedure was followed while noting that two genuine unaccompanied minors on the same vessel were placed under protective care.

In a separate case, the TSJC’s social chamber declared the dismissal of a Mercadona employee in Fuerteventura null after finding that private detectives had illegally accessed her medical data. The court ordered her reinstatement, awarded €15,000 for moral damages, and imposed costs on the supermarket chain for violating her privacy and discriminating against her multiple sclerosis condition.
