Italy speed camera regulations: Court rules on fine validity

Recent legal and administrative developments in Italy have clarified the validity of speed camera fines. The Court of Cassation ruled that the absence of flashing lights or luminous warning signs does not automatically invalidate a speeding ticket. Instead, the legality of a fine depends on technical compliance and proper calibration.

To be valid, speed detection devices must be approved and homologated according to Ministry of Transport directives. Furthermore, devices must undergo annual calibration; if the last inspection was more than 365 days ago, the resulting fines are invalid. Additionally, warning signs must be correctly installed and clearly visible, without being obscured by vegetation.

In Ancona, a significant shift in enforcement has been noted. Following changes to calibration thresholds, the number of fines recorded by local police increased from 8,436 between 2024 and 2026 to over 14,000 in the first half of the current year alone. Local officials have defended these actions as necessary adherence to the law following previous administrations' failure to properly regulate device calibration.
