Carmine Agnello faces kidney donation or prison deadline

Carmine Agnello, the grandson of the late Gambino crime boss John Gotti, has been issued a court ultimatum regarding his pending prison sentence and a planned kidney donation for his mother.

Agnello, 39, was sentenced to 15 months in federal prison and ordered to pay $1.2 million in restitution after pleading guilty to fraud involving more than $1 million in COVID-19 relief loans from the Small Business Administration. His prison surrender date had been delayed to allow him to donate a kidney to his mother, Victoria Gotti, who suffers from end-stage renal disease.

An August 3 transplant was postponed due to Victoria Gotti developing a serious infection. Following a request for a further extension, Judge Nusrat J. Choudhury ruled that Agnello can only remain free until September 18 if the transplant is completed by Monday, August 10. If the procedure does not take place by the deadline, Agnello must report to prison by 2 p.m. on Monday.

Federal prosecutors have opposed further delays, arguing that the Federal Bureau of Prisons has medical facilities capable of facilitating organ donations while an inmate is in custody.
