Carmine Agnello must donate kidney to mother or report to prison

A Brooklyn federal judge has issued an ultimatum to Carmine Agnello, the 39-year-old grandson of late mob boss John Gotti. Agnello must either donate a kidney to his mother, Victoria Gotti, by Monday or report to prison to begin serving a 15-month sentence.

Agnello was previously convicted of COVID-19 fraud involving the theft of more than $1 million in pandemic relief funds from the Small Business Administration. While he had received a prior delay to undergo the transplant procedure, complications involving his mother's health delayed the surgery.

Judge Nusrat J. Choudhury ruled that if the transplant occurs on or before Monday, Agnello may postpone his prison surrender until September 18. If the procedure does not take place by Monday, he must report to prison by 2:00 PM. Prosecutors have argued against leniency, suggesting the transplant could potentially be completed while he is incarcerated.
