Casas Bahia mass layoffs suspended by Brazilian labor court

A Brazilian labor court has issued a preliminary injunction suspending mass dismissals carried out by the retailer Casas Bahia. The decision, made by Judge Katarina Roberta Mousinho de Matos, follows an action by the National Confederation of Commerce Workers (CNTC) alleging that the company failed to engage in mandatory prior negotiations with unions.

The injunction requires Casas Bahia to reinstate the legal and economic ties of approximately 1,900 to 3,000 affected employees within five days and reactivate health plans and other benefits within 48 hours. The ruling also prohibits the company from conducting further mass layoffs without union involvement, under penalty of fines.

This legal intervention occurs as Casas Bahia undergoes a major restructuring, which includes the closure of 298 stores and a filing for judicial recovery to manage debts estimated at R$ 17.3 billion. While the court order mandates the reinstatement of workers, it does not require the reopening of the closed physical locations; employees may be reassigned or kept on paid leave.

Additionally, a São Paulo judge has granted temporary protection to the company to prevent creditors from seizing assets, aiming to avoid a financial collapse while the judicial recovery plan is being deliberated.
