Castilla-La Mancha court grants total disability benefits to worker

The High Court of Justice of Castilla-La Mancha has ruled in favor of a home care assistant in Cuenca, recognizing her right to total permanent disability benefits. The court overturned a previous decision by a local social court that had only granted partial disability.

The worker, who began a period of temporary incapacity in July 2022 due to common illness, had her claim initially rejected by the National Institute of Social Security (INSS) in February 2024. The new ruling establishes her right to a benefit calculated at 75% of a monthly regulatory base of 1,100.54 euros, totaling approximately 825.41 euros per month, including legal updates and revaluations. The benefits are retroactive to February 14, 2024.
