Castilla-La Mancha court upholds disability status for Albacete shop owner

The High Court of Justice of Castilla-La Mancha has upheld the total permanent disability status of a self-employed shop owner from Albacete. The ruling rejects an appeal by the Social Security Institute, which sought to revoke the disability status, as well as an appeal by the beneficiary to upgrade the classification to absolute permanent disability.

The worker, who manages a retail store, has a recognized 66% permanent disability and a 27% mobility scale. Although the National Social Security Institute (INSS) initially denied the claim, arguing that her medical conditions—including polyarthrosis and degenerative joint pain—did not sufficiently limit her capacity, the Social Court No. 2 of Albacete ruled in June 2025 that she could no longer perform her usual duties as a shopkeeper and owner.

As a result, she is entitled to receive 55% of a regulatory base of 708.12 euros due to common illness.
