Castrovillari court acquits mother of obstructing child visitation
The Court of Castrovillari has acquitted a young mother of charges alleging she prevented her ex-husband from seeing their minor child, violating a civil court custody agreement.
The case originated from a complaint filed by the ex-husband with the Rossano Centro Carabinieri. The complaint alleged that the mother obstructed the father-child relationship by failing to answer phone calls, keeping her phone turned off, and making it difficult to locate her without justification. These actions were reported to have bypassed a civil ruling that established joint custody, with the child residing with the mother and the father granted visitation rights two days a week, alternating Sundays, and one week during holiday periods.
Following the examination of witnesses and the defense's arguments, the court accepted the requests of defense attorney Francesco Nicoletti. The mother was acquitted under the formula ‘perché il fatto non sussiste’ (because the fact does not exist).
