Catalan court upholds dismissal of waiter over sexual harassment

The High Court of Justice of Catalonia (TSJC) has upheld the disciplinary dismissal of a waiter at an establishment in Salou following a sexual harassment complaint from a female colleague.

The incident originated in the spring of 2024, involving various WhatsApp messages and audio recordings sent by the employee to his coworker. After the employee was formally accused of sexual harassment in June 2024, the company activated its internal protocol, interviewing the complainant, the accused, and five witnesses.

The company classified the actions as a very serious labor offense and terminated the contract. While the court ruling does not establish a criminal conviction or declare a crime, it confirms that the company acted legally and respected the worker's procedural guarantees during the internal investigation.
