CCLA files Charter challenge over legal aid underfunding in Manitoba

The Canadian Civil Liberties Association (CCLA) has filed a Charter challenge against the governments of Manitoba and Canada, alleging that systemic underfunding of criminal legal aid violates the Charter of Rights and Freedoms. This marks the first systemic challenge to legal aid funding levels in Canada.

Legal counsel argues that income thresholds for receiving aid have failed to keep pace with the cost of living, and current funding levels are insufficient to meet the demands of complex criminal proceedings. Consequently, Legal Aid Manitoba has been forced to ration its services, leaving many individuals to represent themselves or face financial ruin.

The CCLA asserts that the underfunding violates rights to a fair trial, life, liberty, and security of the person, as well as equal protection under the law. The lawsuit notes that the burden falls disproportionately on Indigenous people, who face higher rates of poverty and are more frequently represented in the criminal justice system.
