Ceará-Mirim shopping mall ordered to pay for theft in parking lot

A civil court in Ceará-Mirim has upheld a ruling ordering a shopping mall to pay R$ 8,847.10 to two women after a cell phone and a notebook were stolen from their vehicle parked at the establishment.

The compensation includes R$ 3,059.10 for the phone, R$ 1,788 for the notebook, and R$ 4,000 in moral damages. The theft occurred on December 23, 2024, when the victims discovered their vehicle had been breached while they were inside the mall.

Judge Peterson Fernandes rejected the mall's appeal, which had challenged the legitimacy of the claimants and contested the application of STJ Precedent 130, regarding the responsibility of establishments for thefts in parking lots. The final amount will be adjusted for inflation using the IPCA index.
