Celec EP opposes traveling to U.S. for Progen Industries litigation

Celec EP, Ecuador's state electricity corporation, has filed a response with the United States District Court for the Middle District of Florida to oppose a request by Progen Industries LLC. Progen is seeking to compel Celec representatives to appear in person in Tampa, Florida, as part of an ongoing legal dispute.

Celec presented three primary arguments to avoid traveling to the United States. First, the company claims there was a prior procedural agreement, established in a joint case management report in February 2026, allowing witnesses located outside of Florida to testify remotely via video conference, such as Zoom. Celec stated it does not oppose in-person testimony provided it takes place in Ecuador.

Second, Celec noted that two of its four designated corporate representatives lack United States visas. Third, the company cited internal restrictions that regulate the international travel of its public personnel. Celec maintains that the dispute is not about refusing to provide testimony, but rather about the location and method of the proceedings.
