Central Administrative Appeals Commission cancels state land usage fines

The Central Administrative Appeals Commission has resolved a dispute between a local government and the Korea Asset Management Corporation regarding 64.44 million won in compensation fees for the unauthorized use of state-owned land.

The dispute arose when the Korea Asset Management Corporation imposed the fees, claiming the local government had occupied the land used for a coastal walkway without permission between September 2020 and September 2025. The local government challenged this, arguing the land was used for public interest purposes.

The Commission ruled to cancel the compensation fees, noting that when the walkway was constructed in 1999, the local government held delegated authority over state property management. Furthermore, the Commission found that the land was not being used exclusively by the local government, as parts of it served as slopes for urban planning roads.

As a resolution, both parties accepted a mediation plan where the compensation fees are canceled, and the local government will proceed to officially lease or purchase the state-owned land used for the walkway.
