CFTC faces staffing and enforcement declines amid crypto growth

The Commodity Futures Trading Commission (CFTC) is facing a significant reduction in capacity even as the cryptocurrency and prediction market sectors expand. By the end of 2025, the agency's staffing was 21% below its decade-long average, and enforcement actions in 2025 were nearly 80% lower than the previous ten-year annual average.

This contraction occurs as the agency is tasked with developing new rules for these emerging markets. While the CFTC saw a slight staffing uptick in 2026 and aims to hire approximately 100 employees in critical areas by year-end, the recent trend highlights concerns regarding oversight capacity.

Under previous leadership, the CFTC pursued enforcement cases against several major entities, including Gemini, Celsius, FTX, and the prediction market Polymarket. However, since the transition to the second Trump administration, enforcement actions against companies such as Gemini, Celsius, and FTX have rolled back.
