CFTC seeks dismissal of CME Group lawsuit over crypto futures
The U.S. Commodity Futures Trading Commission (CFTC) has requested that a federal court dismiss a lawsuit filed by CME Group. The legal dispute centers on the CFTC’s decision to approve KalshiEX LLC’s Bitcoin perpetual futures contract.
CME Group argues that these perpetual contracts, which allow traders to hold positions indefinitely without expiration, should be classified as swaps rather than futures under the Dodd-Frank Act. This classification is significant because swaps are subject to different and often more burdensome regulatory requirements, such as specific clearing mandates and margin rules.
The CFTC has moved to dismiss the case in the U.S. District Court for the District of Columbia, arguing that CME Group lacks legal standing. The regulator contends that CME failed to demonstrate a concrete competitive injury, noting that the exchange could list comparable perpetual products under the existing regulatory policy. The CFTC characterized the lawsuit as an attempt to use litigation to stifle competition rather than address legitimate regulatory concerns.
