Chhattisgarh High Court rejects divorce plea over insults regarding physical appearance
The Chhattisgarh High Court has dismissed a divorce petition filed by a man who claimed his wife insulted him by calling him ‘dark and fat’. A division bench comprising Justice Parth Pratim Sahu and Justice Sachin Singh Rajput declined to interfere with a previous Family Court decision that had also rejected the plea.
The petitioner, 28-year-old Aksh Ghosh, alleged that his wife, Pooja Sit, exhibited hostile behavior, threatened him with false cases, and frequently left his company. He further claimed that his wife had an extramarital affair and that her comments regarding his physical appearance constituted mental cruelty.
In response, the wife denied the allegations, asserting that her husband had an affair with another woman and had neglected her medical needs during pregnancy. The High Court ruled that remarks regarding a spouse's physical appearance do not, in themselves, constitute sufficient legal grounds for divorce or proven mental cruelty under the circumstances of the case.
