Chiclayo Council seeks Constitutional Court ruling on councilor pay dispute

The Provincial Municipality of Chiclayo has authorized its municipal public prosecutor to file a competency lawsuit before the Constitutional Court. The legal action aims to resolve a conflict regarding which regulations govern the payment of councilor stipends.

The dispute arose after the Comptroller General questioned these payments in an official orientation report. Councilors argue that Law 32269, which sets stipends at 30% of the mayor's monthly salary with automatic adjustments, should prevail. However, the 2025 Budget Law prohibits such increases.

Proponents of the lawsuit claim that the contradiction between an organic law and an annual budget law threatens municipal autonomy as recognized by the Constitution. The decision to proceed was approved by the council with 10 votes in favor and 5 abstentions.
