The legal action was initiated by a man seeking to investigate potential paternity based on claims made by his mother before her death in 2009. The claimant alleged that his mother and the musician had a close relationship in the past, a secret kept for decades due to fear of social repercussions.

In his defense, Buarque described the request as ‘absurd’ and ‘unwarranted,’ denying any relationship with the man's mother or any family connection. His legal team argued that the alleged contact was impossible given his public status and marital status at the time.
