Chihuahua electoral reform invalidated by Supreme Court
The Supreme Court of Justice of the Nation (SCJN) has issued a ruling regarding Chihuahua's electoral reform, which aimed to prevent organized crime from influencing elections. The Court invalidated several provisions of the reform, including sanctions that would have resulted in the loss of candidacy for individuals linked to criminal activities. The SCJN argued these sanctions violated the principle of proportionality and lacked a sufficient basis for personal imputation.
Governor Maru Campos criticized the decision, accusing the Morena party of litigating to remove protections against organized crime. She stated that the ruling allows candidates who benefit from illicit financing or threats to retain their positions.
Additionally, the Court found that the Chihuahua Congress failed to include provisions regarding foreign interference as a cause for election annulment. The Court has ordered the local legislature to harmonize its laws with the federal Constitution to address this omission. However, any new regulations regarding foreign interference will not be applicable until the 2030 election cycle due to constitutional requirements for timely publication.
