Chihuahua legislature approves AI regulation for digital violence crimes

The Feminicides Commission of the 68th Legislature of the Congress of Chihuahua has approved a draft report aimed at regulating the use of Artificial Intelligence in crimes involving digital violence, sextortion, and child pornography.

Because there is currently no specific regulatory framework for these technologies in this context, the proposal seeks to amend several articles of the State Penal Code. Key measures include the temporary or permanent disqualification of legal entities that use digital technologies or AI to commit crimes. Additionally, the project mandates the seizure, elimination, or immediate blocking of technological instruments, programs, or algorithms used in such offenses, as well as the suppression of generated digital files.

The proposal also suggests that the use of AI, automated algorithms, or digital systems designed to generate digital violence or amplify the reach and damage of an illicit act should be considered an aggravating circumstance to increase criminal penalties.
