Chile debates delay of new data protection law
Chile is currently debating a potential delay in the implementation of Law 21.719, a new data protection law approved in December 2024. While the law is scheduled to take effect in December 2026, the government has proposed a one-year postponement to allow for the establishment and operational preparation of the regulatory agency responsible for overseeing and sanctioning the misuse of data.
The law establishes rights regarding access, rectification, suppression, opposition, and portability of personal information. This legislative movement follows Chile’s 2021 constitutional inclusion of neuro-rights to protect physical and mental integrity against scientific and technological developments. The ongoing debate highlights a growing public demand for autonomy over personal information and the necessity of functional institutions to enforce these digital rights.
