Chile enacts new law to combat contraband thrown into prisons

Chile has implemented Law No. 21.834, a new regulation designed to strengthen prison security by targeting the practice known as “pelotazos.” This method involves throwing prohibited items, such as mobile phones, weapons, and illicit substances, over prison perimeters from the outside.

The law amends Article 304 Bis of the Penal Code, expanding penalties and providing new tools for criminal prosecution. Sentences for these offenses range from 61 days to three years of imprisonment. Penalties may increase by one degree if the thrown object has the potential to compromise the security of the facility.

Jean Paul Zimmermann, the acting Seremi of Public Security, Justice, and Human Rights, noted that the Aysén region has also experienced attempts to smuggle drugs and phones via this method. The new legislation aims to support the work of Gendarmería and create a more secure penitentiary system.
