Chile approves law to accelerate administrative migrant expulsions

The Chilean Senate has approved a legislative reform to the Migration and Foreigners Law, aimed at streamlining the administrative expulsion of irregular migrants. The new regulations grant the Investigative Police (PDI) the authority to request judicial authorization to enter homes to apprehend individuals with active expulsion orders.

Key provisions of the law include extending the re-entry ban for expelled foreigners from three to five years and increasing the timeframe for the State to complete a deportation to 30 days following notification. Additionally, migrants charged with crimes carrying sentences of less than three years may face immediate expulsion without waiting for a trial. The law also introduces a mandatory biometric registry and new mechanisms to locate individuals subject to expulsion.

This legislative move follows reports from the government that Chile has executed 2,000 expulsions so far in 2026. Authorities, including Interior Undersecretary Máximo Pavez and Migration Director Frank Sauerbaum, indicated that deportation efforts will increase, potentially utilizing daily commercial flights supported by an additional $1.7 million in budgetary funding.
