Chile Supreme Court upholds insurance payout for stolen vehicle

The Supreme Court of Chile has upheld a ruling requiring BCI Seguros Generales S.A. to pay an indemnity of 483.88 UF to an insured individual following the theft of a 2017 Nissan NP 300 DCAB 4WD.

The dispute arose after a vehicle bearing the victim's license plates was recovered by Carabineros, though it was determined not to be the actual insured vehicle. The insurance company had initially rejected the claim, arguing that the insured party failed to properly identify the asset and prove the occurrence of the theft, invoking the exception of an unfulfilled contract.

However, the First Civil Court of Santiago previously ruled that the insurer was obligated to pay the commercial value of the stolen asset. The Supreme Court rejected the insurer's appeal for cassation, confirming the obligation to pay the indemnity.
