Chilean court rules in favor of Interchile S.A. in environmental dispute

Chile's Second Environmental Court has ruled in favor of Interchile S.A. regarding a dispute over its Compliance Program (PdC). The ruling follows the rejection of the program by the Superintendency of the Environment (SMA) concerning infractions related to the “Plan de Expansión Chile LT 2×500 kV Cardones-Polpaico” project.

The court determined that the SMA violated the duty to motivate administrative acts and the principles of conclusiveness and contradictoriness. Specifically, the SMA failed to address the full range of charges and allegations presented by the company, limiting its response to only charges N°2 and N°4. The court emphasized that the administration is obligated to resolve all allegations made by interested parties in administrative proceedings so that companies can understand the specific deficiencies attributed to them.
