Chilean inheritance tax regulations and obligations
The National Taxpayer Defender (DEDECON) has provided guidance on the tax obligations associated with inheritances in cases where no will exists. Under Law No. 16.271, these taxes are administered by the Internal Revenue Service (SII).
The tax is calculated based on the value of the assets received—such as money, vehicles, shares, housing, and land—as well as the relationship between the beneficiary and the deceased. The law provides specific exemptions: 50 UTA for spouses, children, parents, and their descendants, while siblings, uncles, aunts, nephews, nieces, and cousins are entitled to an exemption of 5 UTA.
Progressive tax rates ranging from 1% to 25% are applied to the taxable amount, and additional surcharges may apply depending on the degree of kinship.
