Chilean judicial independence and pardon debates highlighted
Historian Loreto Correa has highlighted the importance of judicial independence in Chile regarding a dispute over seized Bolivian timber in Arica. Correa noted that the Chilean Executive branch has minimal influence over judicial decisions or criminal investigations conducted by the Public Ministry. She suggested that while diplomatic dialogue between Chile and Bolivia is necessary to improve institutional communication, the Chilean government cannot directly intervene in legal proceedings governed by national law.
Separately, Chile’s Minister of Justice and Human Rights, Fernando Rabat, addressed the ongoing debate regarding potential pardons for former military personnel convicted of human rights violations and individuals involved in social unrest. Rabat stated that the government has not set specific deadlines for these decisions, emphasizing that they must be handled on a case-by-case basis according to available evidence. He noted the sensitivity of the matter and the importance of acting with caution to address legitimate public interest without creating political controversy.
