Chilean Senate Commission approves personal data protection law changes

The Senate Constitution Commission has approved a project to modify Law No. 21.719, which regulates the protection and processing of personal data and establishes the Personal Data Protection Agency.

The approved modifications include postponing the law's entry into force to October 15, 2027, rather than the December 1, 2027, date originally proposed by the Executive. Additionally, the number of members on the Agency's Board of Directors will increase from three to five.

Regarding appointments, the commission rejected a proposal to lower the quorum for approving appointments from two-thirds to four-sevenths, maintaining the higher requirement. For the initial designation of councilors, the President will propose five individuals with staggered terms of six, four, and two years. The Senate must approve this proposal as a single unit with a two-thirds majority. If rejected, the President has 15 days to submit a new proposal.
