Chilean Supreme Court limits prosecutor access to devices in Junaeb case
The Chilean Supreme Court has established specific limits on the Prosecutor's Office regarding the review of seized electronic devices in the Junaeb investigation. Confirming a ruling from the Santiago Court of Appeals, the Supreme Court's Second Chamber dictated that the prosecution must follow strict protocols when examining and transferring information from seized hardware.
The decision follows an amparo filed by the defense of attorney Darío Calderón, who is being investigated alongside politicians Sergio Gahona, Hugo Gutiérrez, and Miguel Ángel Calisto. The investigation involves allegations of money laundering, bribery, and public fraud.
Key measures mandated by the court include: the custody of seized devices must be managed exclusively by the Regional Prosecutor's Office and the responsible Deputy Prosecutor; the Public Ministry must report the names of all officials or experts accessing the devices to the Fourth Guarantee Court of Santiago; and access to information is restricted to specific investigative parameters to prevent the inclusion of unrelated data.
