Chile's frontal weather system prompts labor rights and duties for workers and employers
Intense rains and flooding from a frontal weather system are disrupting transport, water and electricity supplies across Chile. Labor lawyer Matías Espinoza of GrupoDefensa explains that employers may not sanction or dismiss employees who cannot reach their workplace because of flooded streets, suspended metro service or bus route interruptions. Employers also cannot deduct wages for lateness caused by such transport delays.
When basic services such as water are cut, the employer must suspend work and promptly notify the Labor Inspection. For teleworkers, power or internet outages are considered a "passive workday" and must not lead to salary reductions. If a job site presents safety hazards due to the weather, work must be halted immediately and appropriate protective equipment provided. Espinoza stresses the employer’s duty of protection to safeguard workers’ health and safety during these emergencies.
