China to regulate influencer agencies with new content laws
China is implementing new regulations targeting Multi-Channel Network (MCN) agencies, the intermediaries that manage influencers and distribute content on platforms such as Douyin, Xiaohongshu, and Bilibili. The 'Regulation on the Management of Multi-channel Internet Information Content Distribution Services' was issued by five state bodies, led by the Cyberspace Administration of China (CAC).
Effective September 1, the law shifts enforcement from individual influencers to the agencies behind them. Unregistered MCNs must register with provincial cyberspace authorities and specify their business activities. Existing agencies have 30 days to align their operations with the new rules. Platforms hosting these agencies are required to verify their qualifications and report cooperation details to authorities.
The regulations introduce several prohibitions, including the incitement of hatred or regional discrimination, the exploitation of minors and persons with disabilities for profit, and the falsification of engagement metrics like views, likes, and followers. Additionally, agencies are prohibited from glorifying crime or disasters and must prevent online peer violence. To ensure compliance, agencies must appoint content management directors, maintain dedicated supervision teams, and sign contracts with creators that clearly define information security responsibilities.
