Écija sexual assault convicts appeal sentences to TSJA

The High Court of Justice of Andalusia (TSJA) has begun the process of reviewing a conviction against three men for a sexual assault that occurred in Écija in March 2024. The defendants, who are currently in provisional detention, have filed appeals seeking to overturn the ruling by the Provincial Court of Seville, which imposed prison sentences ranging from thirteen years and six months to fifteen years.

The original ruling found that the men took advantage of the victim's state of alcohol intoxication to commit non-consensual sexual acts inside a vehicle. In addition to prison time, the sentence included a twenty-year prohibition on communicating with or approaching the victim.

Defense lawyers argue there was an error in the assessment of evidence, claiming the victim's will was not proven to be totally annulled and questioning the credibility of the testimony. Conversely, the Public Prosecutor's Office and the victim's representatives oppose the appeals, citing robust evidence including security camera footage and DNA reports.
