Écija sexual assault victim's family to appeal sentence reductions
The family of a sexual assault victim in Écija has announced plans to appeal to the Supreme Court following a ruling by the High Court of Justice of Andalusia (TSJA) that reduced the sentences of three defendants.
While the TSJA upheld the proven facts and confirmed that the three accused were responsible for the sexual assault of a young woman who could not consent, it lowered the prison terms. Two of the convicted individuals had their sentences reduced from 13 years and 6 months to 7 years, while a third saw a reduction from 15 to 10 years.
The reduction occurred because the TSJA did not apply the aggravating factor regarding joint action by two or more people, as it did not classify any of the defendants as a necessary collaborator under the Penal Code. The victim's legal representation has rejected this interpretation, arguing that the defendants' collective participation in the crime meets the legal requirements for joint action.
