EU Court rejects Poland's bid to suspend Mercosur trade deal

The Court of Justice of the European Union (CJEU) has rejected a request from Poland to temporarily suspend the provisional application of the trade agreement between the EU and the Mercosur bloc. Poland had sought an interim measure to halt the agreement, which includes Argentina, Brazil, Paraguay, and Uruguay, until a final ruling is issued on the legality of the deal.

The Court ruled that Poland failed to demonstrate that the continued application of the agreement would cause “serious and irreparable damage” to the European market, specifically regarding the agricultural sector. The court noted that Poland's arguments were largely general and abstract, lacking concrete evidence of imminent harm.

The trade agreement, which aims to eliminate tariffs on over 90 percent of goods, has faced significant opposition from several EU nations, including France, Poland, and Austria, due to concerns over unfair competition and environmental standards. While this decision denies the immediate suspension, it does not resolve the underlying legal challenge; the CJEU is expected to issue a final judgment on the merits of Poland's complaint at a later date.
