CJI Surya Kant calls for new legal status for climate-displaced people

Chief Justice of India Surya Kant has called for the creation of a specific legal status for individuals displaced by climate change, noting that existing refugee and migration laws are inadequate for such displacement. Speaking at the High-Level Commonwealth Policy Dialogue on Climate Justice in London, Kant warned that the climate crisis will challenge long-standing legal categories.

Kant emphasized that judicial institutions must ensure legal certainty for the most vulnerable populations. He argued that courts should seek a balance between environmental protection and the legitimate needs of economic development, suggesting that the two should not be viewed as mutually exclusive.

The Chief Justice also addressed the inequities of the global energy transition. He noted that industrializing nations are often pressured to adopt renewable energy rapidly, despite developed nations having built their economic strength on fossil fuels for centuries. He advocated for a fair distribution of the burdens associated with this transition and encouraged courts within the Commonwealth to share legal approaches and solutions to address climate-related challenges.
