CNMC approves Correos network and investigates Renfe

Spain’s National Markets and Competition Commission (CNMC) has issued two significant regulatory decisions involving major state-linked entities.

First, the CNMC approved an intra-group agreement between Correos and its subsidiary Correos Express to manage a joint network of collection and return points. The regulator determined that the alliance poses no significant risk to competition and ensures that public funds used for traditional postal services are not utilized for this commercial network. To protect small businesses, the agreement prohibits exclusivity clauses, allowing participating local shops to work with other courier companies. The network is intended to share costs at cost-price between the parent and subsidiary.

Second, the CNMC has opened disciplinary proceedings against Renfe and seven of its subsidiaries for alleged abuse of a dominant position and market sharing in the rail freight sector. The investigation, prompted by a complaint from the Association of Private Railway Companies (AEFP), examines whether Renfe entities applied discriminatory commercial conditions regarding traction services and wagon rentals. Additionally, the regulator is investigating a potential collusive agreement to divide the freight market, specifically concerning the transport of automobiles and components.
